Jerry is widely recognized as a formidable fiduciary litigator who enjoys unraveling complicated estate-related matters, including

  • Disputes among executors, trustees and beneficiaries

  • Disputes involving accountings and closely held businesses

For more than 40 years, Jerry has set his clients’ minds at ease with his humanistic hands-on, approach to their estate-related concerns. He is sensitive to clients’ needs, goals and pocketbooks when constructing strategies to solve their problems.

Jerry’s clients appreciate his relentless pursuit of their goals and his deep knowledge and experience representing clients before the New York Surrogate’s Courts. This, combined with his uncanny ability to “read” opposing clients and counsel lead to unusual opportunities to achieve his clients’ goals while minimizing their risks.

Jerry is a peer-elected Fellow of the American College of Trust and Estate Counsel, where he is an active member of committees on fiduciary litigation, business planning and asset protection. He was a founding partner of Mazur Carp & Rubin and chair of the firm’s Trusts and Estates practice. In July 2013, Mazur Carp & Rubin combined with Schiff Hardin.

  • Experience

    • Recovered substantial family wealth from an interloper through multiple contentious court proceedings.
    • Achieved notable trial court and appellate victories to collect full contract damages plus interest for a client in family dispute over a succession agreement of family business.
    • Represented Corporate Trustee in the successful resolution of a dispute commenced by an angry and menacing trust beneficiary.
    • Defended the trustee of a private foundation in multiple court proceedings seeking his removal. Jerry engineered favorable settlements in which charges were withdrawn, permitting the client to continue his charitable work as Chair of the foundation’s Board of Trustees.
    • Recovered two-thirds of a decedent’s estate for his children in probate contest where the decedent’s second spouse sought probate of a Will bequeathing the estate to her.
    • Commenced court proceeding that succeeded in the removal of a “deadbeat dad” as trustee of trust for himself and his remaindermen children.  A bank of our clients’ selection was substituted as trustee.
    • Represented wealthy multiple generational family through successive I.R.S audits, commercial and  real estate issues and complex estate planning.
    • Represented grandchildren remaindermen of family trust in complex court proceedings. Succeeded in the removal of dissonant family trustees and qualification of independent sole trustee.
    • Uncovered large amount of income and collected same for income beneficiaries of a $500 million trust fund.
    • Defended decedent’s handwritten Will against family attack in contested probate; preserved over 80 percent of estate for Will beneficiaries.
    • Defeated IRS in Tax Court trial against claimed taxpayer errors in execution of sophisticated estate plan.
