Jack Drogin and Rachael Schwartz were contributing authors to the American Bar Association’s recent white paper titled, “Digital and Digitized Assets: Federal and State Jurisdictional Issues.” Together, they collaborated with several other authors to pen Section 6, which covers the scope, requirements, and enforcement of FinCEN regulation.
The report provides a comprehensive survey of the regulation of cryptocurrencies and other digital assets at both the state and federal levels, including definitions relevant to digital currency and domestic regulatory issues, as well as what international bodies and other countries are doing when confronted by the new technology. It was prepared by the Derivatives and Futures Law Committee Innovative Digital Products and Processes Subcommittee Jurisdiction working group.
