Construction Practice Group Leader Ken Roberts was quoted on arbitration proceedings as a time- and cost-effective method of handling construction disputes outside of a courtroom.
Ken said that, in his experience, a skilled arbitrator can reach a decision up to four times faster than a court. He added that the only time he has seen construction arbitrations last longer or cost more than a trial is when the arbitrators themselves lack control.
“It’s only when the arbitrators lose control over the process, or are not focused on the process, that an arbitration meanders longer than a trial, costs more than a trial,” he said. “I think the biggest danger is if you have people on your panel who have a lot of time, and they’re more than happy to hear whatever comes in, for however long it takes. That’s a danger sign.”
