Labor and Employment Practice Group Deputy Leader Lauren Novak was quoted on the U.S. Supreme Court Janus v. AFSCME ruling that public sector unions cannot charge fair use fees to non-union members and what could happen to public sector unions as a result.
Lauren said that it remains “a big open question whether this will be the death knell for public-sector unions. [The ruling] certainly dealt a big blow to them, there is no question.”
Lauren added that the First Amendment issues at play in Janus “aren’t going to be at play on the private-sector side,” but noted the private sector could be affected if there is a push for federal right-to-work legislation that would cover private-sector workers.
“I don’t necessarily see that as a direct result of Janus, but I think that the conversation is headed in that direction,” she said.
