Aly Quoted on Lessons Learned from Key U.S. Supreme Court Patent Constitutionality Decision
Intellectual Property Group Co-Leader Imron Aly was quoted on a U.S. Supreme Court patent ruling in Oil States Energy Services LLC v. Greene’s Energy Group LLC that upheld the America Invents Act (AIA) review system for challenging patents as constitutional, with some key operation changes.
However, a recently filed class action alleges that Patent Trial Appeal Board’s invalidation of patents is an unconstitutional taking of property rights.
Imron said, "There will always be an incentive to attack a system that can invalidate patents cheaper and faster than district court."
