Summary:
Schiff Hardin brought a series of nine lawsuits over a three-year period on behalf of The Thermos Company and its parent, Nippon Sanso Corporation, to protect our clients' design patent and trade dress rights in an industry-leading, vacuum-insulated travel tumbler.
Our clients had introduced their tumbler in late 1994. It was an instant success among coffee drinkers, commanding a retail price in the $25 to $30 range. By 1996, a rash of imitators had come to market.
All of these cases were settled on terms favorable to our client. As a result, the infringing tumbler designs are no longer on the market.
