Schiff Hardin represents a coal-fired electric utility in connection with the investigation of alleged releases of coal ash constituents to groundwater. Beginning in 2000, the United States Environmental Protection Agency (EPA) and the Indiana Department of Environmental Management began conducting testing of private drinking water wells in a northwest Indiana community to determine whether fly ash-derived constituents had released from a local fly ash disposal facility into groundwater. Over the next several years, we negotiated a series of Administrative Consent Orders pursuant to which our client and the disposal facility operator conducted interim removal actions in the form of extending municipal water service to approximately 270 residential homes and businesses. We also negotiated another Administrative Consent Order providing for the performance of a streamlined Remedial Investigation and Feasibility Study (RI/FS) encompassing an area of approximately two square miles.
