In today's bankruptcy environment, Section 363 sales have become the mechanism of choice for a debtor in possession. But does a quick sale under Section 363 of the Bankruptcy Code improve your chances to recover from the bankruptcy estate? This module will shed some light on the Section 363 sale process and provide you with some insight into what to expect and how your rights may be affected by a Section 363 sale. We will also showcase how to navigate the process of being a buyer of assets from a bankruptcy estate, including becoming a stalking horse bidder and controlling the sale process.
