Eric L. Barnum, a partner in Schiff Hardin's Labor and Employment Group is a panelist on "Who Says You Can't Have it Both Ways?" The teleconference is sponsored by the American Bar Association's Section of Labor and Employment Law and takes place on Wednesday, Feb. 17, 2010.
Positional and issue conflicts is when a lawyer or law firm takes one position in one matter and a conflicting or inconsistent position in another matter. This is an emerging area of employment law ethics. As firms shed single constituency representation and an increasing number of unions engage in affirmative individual worker rights litigation, it is often difficult for lawyers to strike the right balance. The panel of employment law and legal profession experts will discuss how to navigate these positional and issue conflicts in relation to labor and employment law.
The panel will cover critical areas including:
- Conflict and representational issues with respect to non-compete clauses and executive compensation.
- Positional conflict issues arising in employment discrimination cases.
- Positional conflict issues arising in wage and hour cases.
- Conflict issues arising in duty of fair representation cases.
