Roger E. Smith concentrates his practice in energy regulation, litigation and transactions. He represents investor-owned utilities, electric distribution companies and regional transmission organizations regarding:

Experience

Mr. Smith's significant representations prior to joining Schiff Hardin include:

  • Obtained regulatory approval for RTO/ISO of a proposal regarding the appropriate pricing and modeling of interchange transactions (i.e., imports and exports between the RTO/ISO system and other Balancing Authority Areas) in conjunction with the use of location-based marginal prices (LMPs)
  • Obtained regulatory approval for RTO/ISO of use of short-term and long-term transmission rights (Congestion Revenue Rights)
  • Counseled regional transmission organization (RTO)/independent system operator (ISO) regarding its implementation of long-term firm transmission rights
  • Counseled RTO/ISO regarding redesign of competitive wholesale energy and ancillary service markets using transmission congestion charges based on location-based marginal pricing (LMPs)
  • Represented investor-owned utility (IOU) in transmission rate and rate design proceedings involving integration of various IOUs into PJM and the Midwest ISO
  • Regulatory counsel for IOU regarding a hold harmless transmission rate condition for Michigan and Wisconsin
  • Represented a Midwestern IOU regarding the development and implementation of a Joint Operating Agreement between the Midwest ISO and PJM
  • Represented a Midwestern IOU regarding protection of grandfathered transmission contracts with implementation of the Midwest ISO's Transmission and Energy Market Tariff
  • Counseled Western utility in FERC investigation into potential manipulation of electric and natural gas prices in the West
  • Regulatory counsel for Midwestern IOU regarding the filing of an ancillary services tariff
  • Regulatory counsel for Midwestern IOU regarding the filing of a transmission formula rate
  • Represented Southeastern IOU regarding approval of its integrated resource plan before state public utility commission
  • Represented Southeastern IOU regarding FERC approval of power sales agreement with an affiliated company
  • Represented Midwestern IOU in revising transmission and ancillary rates under complex set of interconnection agreements
