His experience includes commercial litigation, class actions, appeals, and alternate dispute resolution, on both the plaintiff and defendant sides, and has involved:

Experience

Mr. Scott's recent representations include:

  • Winning a $13 million jury verdict on behalf of Newell Rubbermaid's BernzOmatic division, the plaintiff, after a two-week trial in Charlotte, North Carolina on breach of contract, trade dress, and false advertising claims, and obtaining on post-trial motions an additional $2.75 million award, including attorneys' fees, and a permanent injunction entered by the court.
  • Winning summary judgment on 10 of 11 counts asserted by the plaintiff against a futures commission merchant, and favorably resolving the lone remaining count, in a lawsuit over the plaintiff's trading losses. Shroff v. Rosenthal Collins Group, LLC, et al., 2009 WL 2704582 (N.D. Ill. Aug. 25, 2009).
  • Winning the appeal of a dispute between former business partners over the proper interpretation of an arbitration agreement. Dockser v. Schwartzberg, 433 F.3d 421 (4th Cir. 2006).
  • Persuading an Illinois state court to dismiss a shareholder derivative action against the officers and directors of a major medical supplies company.
  • Obtaining a favorable arbitration award for a leading manufacturer of writing instruments in a proceeding before the American Arbitration Association (AAA).
  • Winning summary judgment in two related liability insurance disputes in federal court in Alabama, and winning the appeals in both cases. Home Ins. Co. v. Hartford Fire Ins. Co., 164 Fed. Appx. 950, 2006 WL 231646 (11th Cir. 2006); Twin City Fire Ins. Co. v. Colonial Life & Acc. Ins. Co., 375 F.3d 1097 (11th Cir. 2004).
  • Winning summary judgment for a national insurance carrier in California state court.

Pro Bono Activities

Mr. Scott also participates in multiple pro bono matters, including the representation of a death row inmate in Alabama and several plaintiffs in an establishment clause lawsuit in the Seventh Circuit.
