Ms. Rowe focuses her practice on construction law. She represents owners, developers, architects, engineers, contractors, subcontractors, suppliers and lenders in a variety of construction-related matters on both public and private projects.
Contracts. Ms. Rowe has significant experience in contract drafting and negotiation, contract administration, and contract enforcement with respect to small to multi-million dollar contracts. She has experience with multiple contracting methodologies including, among others, unit price, fixed price, guaranteed maximum price, time-and-materials, and complex engineer/procure/construct (EPC) and target price approaches.
Energy. As part of her energy practice, Ms. Rowe has worked with regulated utility and independent power provider clients in a variety of capacities. Ms. Rowe assists large utilities in contract management, change order review and management, project oversight, contractor correspondence, and claim resolution, including resolving multi-million dollar claims before they reach litigation. Ms. Rowe has also successfully mediated complex delay and lost productivity claims arising out of utility construction, the result of which was overall cost savings to the project. Ms. Rowe advises utilities on how to implement effective processes and procedures for managing large construction projects and minimizing claims. These services are designed to help the project come in on time and on budget.
Dispute Resolution. Ms. Rowe is an experienced construction litigator who has prosecuted and/or defended claims for construction defects, mortgage/lien foreclosure, structural damage, damage to adjacent properties, mechanics liens and non-payment, among other things, in litigation and alternative dispute resolution (mediation and arbitration). Before formal claims are filed, Ms. Rowe works with clients to find practical, economical solutions for purposes of avoiding litigation. These solutions focus not only on the client's rights and obligations under the law but the practical implications for the client's business and business relationships.
Public Procurement. Ms. Rowe has expertise in public procurement law. Her experience spans all stages of the bid process including preparing Requests for Proposal (RFPs), administering the review process, advising clients of their rights and limitations in awarding the contract, and avoiding bid protests. She has also assisted in developing detailed bid review processes.
Creditors Rights. Ms. Rowe is also a member of the firm's Restructuring, Bankruptcy and Creditors' Rights Group. In that capacity, Ms. Rowe primarily advises claimants, lenders and other creditors in construction-related bankruptcies. Her experience includes, among other things, advising claimants of their lien rights in bankruptcy, helping lenders to rid their collateral of mechanics lien claims, and implementing strategies for effectively managing numerous lien and trust fund claims within a single bankruptcy.
