Ruth E. Krugly

Of Counsel

Ruth E. Krugly’s practice focuses on issues of public law. She represents developers and other private entities in matters pertaining to a diverse array of public law issues, including litigation involving land use disputes, eminent domain proceedings, governmental contract disputes, and complex constitutional and statutory questions. She has provided general corporation counsel services to numerous local governmental bodies, including cities and villages, park districts, and has also represented them in various types of litigation, including zoning matters, administrative proceedings, election disputes, and eminent domain cases. Ms. Krugly has also served as bond counsel in a variety of financings for various units of local government.

Experience

Ms. Krugly:

  • Successfully represented the Chicago Bears in conjunction with the litigation filed attacking the Solder Field renovation project, and developed the theories which led to a successful outcome in the Circuit Court, Appellate Court and Illinois Supreme Court.
  • Had primary responsibility for researching and writing a Report issued by the Cemetery Oversight Task Force in response to the tragic events which occurred at Burr Oak Cemetery; the detailed findings and recommendations contained in the Report served as the basis for the sweeping reforms subsequently enacted by the General Assembly in the Cemetery Oversight Act.
  • Successfully defended a joint venture in a debarment proceeding brought against the joint venture by the City of Chicago.
  • Successfully protected from disclosure under the federal Freedom of Information Act information deemed highly sensitive by a government contractor.
  • Successfully negotiated complex land use issues involved in establishing a new corporate headquarters in suburban Cook County.
  • Successfully represented a candidate in connection with objections challenging the validity of his nomination papers.
  • Successfully represented a real estate developer against a claim that a parcel of property was a public right-of-way, by demonstrating to both the Circuit and Appellate Courts that there was never a proper statutory or common law dedication of the parcel to the public and that ownership of the parcel remained vested in the developer.
  • Successfully represented the University of Illinois at Chicago in eminent domain proceedings instituted in conjunction with the expansion of the University’s educational facilities.
  • Successfully defended a municipality and eight of its officials against Union Pacific (a $14 billion company) in a multimillion-dollar lawsuit alleging breach of contract, tort claims and constitutional violations.
  • Successfully defended a municipality and 11 of its officials in a quo warranto lawsuit filed by a former official seeking reinstatement to his aldermanic office.
  • Successfully asserted the right of a prominent developer and land owner challenging the rezoning of nearby, but not adjacent, property.
  • Successfully defended the Illinois State Toll Highway Authority in a class action challenging the constitutionality of the Toll Highway Act.
  • Successfully defended a municipality in a case attacking the validity of the municipality’s two tax increment finance districts.
  • Successfully defended a park district in breach of contract case filed by former executive director.
