Brian D. Kluever's nationwide practice concentrates in real estate law, including:

Mr. Kluever regularly represents corporations, as well as real estate developers and investors, in the acquisition, disposition and leasing of varied and unique industrial properties. This practice is comprehensive and involves all aspects of a real estate transaction including negotiating and drafting real estate contracts, leases and other land use agreements, performing due diligence and handling closings. The projects have been diverse and involved properties of various type, size and location. These projects often have included unique environmental, zoning and other land use issues. Mr. Kluever has also closed on numerous sale-leaseback transactions involving industrial properties.

Mr. Kluever is actively involved in all real estate and land use aspects of renewable energy projects, with a particular emphasis on wind development. He has represented regulated utilities, developers and owners in acquiring, selling and developing wind energy projects. These projects have involved assisting clients with evaluating and securing options, easements and other land use rights, evaluating and securing required land and construction related special use permits, licenses and approvals and assisting with project compliance issues.

Renewable energy representations:

  • A public utility in all phases of the acquisition, development and operation of wind energy projects and transmission of wind energy
  • A national wind developer in connection with local zoning, permitting, licensing and other transmission and land use issues for multiple wind energy projects located or to be located in twelve counties throughout Illinois
  • A national wind developer in connection with local zoning, permitting, licensing and other transmission and land use issues for the acquisition and development of a wind energy project located or to be located in two counties in Illinois.
  • A public utility in the acquisition and subsequent disposition of wind easements, permits and licenses for a wind energy project
  • A transmission company in the acquisition of easements and other real property rights to establish a transmission corridor through six counties in Illinois
  • A public utility with real estate and land use issues involved with licensing a hydro-electric dam

Real estate representations:

  • Ridge Property Trust in the acquisition of a series of industrial buildings in Texas
  • A manufacturer in the sale of a major industrial property along the Calumet River in Chicago for development and operation as a coal transload facility
  • A logistics company in the sale and lease back of its warehouse and distribution facilities in Indiana and Iowa
  • State Farm Insurance Company in a portfolio sale of industrial buildings and in a portfolio sale of office buildings located throughout the United States
  • Midas International in the sale of a major warehouse and distribution center in Massachusetts and the sale and leaseback of its principal warehouse and distribution facilities in Illinois
  • A REIT/developer in the creation of a joint venture agreement for investment in a portfolio of existing and to be developed commercial/industrial properties
  • A sale/leaseback transaction for a large warehouse/stevedoring operation with the Indiana Port Commission
  • The John Buck Company in the sale of a major office building in Chicago
  • Lake Erie Land Company in a joint development of a mixed use commercial, retail, and residential project comprising nearly 1,500 acres in Indiana
