Mark C. Friedlander concentrates his practice in construction law, both transactional and litigation.

His clients include virtually all participants in the construction industry:

For these clients, Mr. Friedlander provides services to form and incorporate new businesses, to structure transactions, to draft and negotiate contracts, and to resolve and litigate disputes.

He also provides counseling regarding issues of construction law and related areas, including employment, copyright and public procurement.

A significant portion of Mr. Friedlander's practice involves structuring construction projects and advising clients regarding project delivery methods. Mr. Friedlander has received national acclaim for his explanations and analyses of design-build methods of project delivery. He was chairman of the Professional Practices and Contract Committee of the Design Build Institute of America and is among the most frequently sought-after writers and speakers in the country on the law and practice of design-build construction.

Mr. Friedlander's most recent endeavor has received a great deal of national attention. He has developed a new business structure for design-build projects in which the design professional leads the design-build team with a general contractor as its subcontractor for construction. He has prepared and copyrighted a set of contract documents that effectuate these unique design-build relationships. Architects and engineers of all sizes and specialties have been using Mr. Friedlander's business structure and contract documents with considerable success.

Commercial Litigation

Mr. Friedlander also practices in the fields of commercial litigation and professional liability defense. He established an important precedent in the federal courts with regard to the recovery of attorney's fees in frivolous claims, and is a leading commentator on the viability of tort claims for professional malpractice seeking recovery of solely economic losses.

He defends real estate brokers, accountants, attorneys and insurance brokers in professional malpractice actions, and represents businesses and individuals in commercial litigation.
