Paul Schuck concentrates in intellectual property and general commercial litigation.
Mr. Schuck has represented both plaintiffs and defendants in numerous patent, trade secret, and trademark lawsuits in courts across the country. These cases have involved a broad array of technologies, ranging from computer software to biotechnology to business methods.
Mr. Schuck also has represented clients in appellate matters before the Federal Circuit, Ninth Circuit, and California appellate courts.
Experience
- Represented Eastman Kodak Company in two separate patent disputes concerning medical imaging systems.
- Defended a leading computer company in patent litigation concerning Internet databases. Obtained summary judgment of non-infringement, which was affirmed in Hoffer v. Microsoft Corp., International Business Machines Corp. and Ariba, Inc., 405 F.3d 1326 (Fed. Cir. 2005). Successfully obtained dismissal of claims in a related trade secret case.
- Represented major biotechnology company in high-profile, multidistrict litigation regarding basic recombinant DNA technology patent that was favorably resolved when the patent holder entered into a covenant not to sue.
- Represented a gaming industry company in patent and trade secret disputes involving numerous patents for table game monitoring technology.
- Successfully represented leading technology company in patent infringement trial concerning cell phone text-input technology. Jury verdict in favor of client was upheld after extensive post-trial motion practice.
- Conducted pre-filing investigation and analysis for a software provider seeking to enforce its patent rights.
- Represented a foreign manufacturer of light emitting diodes in patent litigation with a U.S.-based industry leader.
- Represented a major software-producer in case where each party alleged infringement of patents for software-development environments.
- Defended a start-up semiconductor producer in an employee movement trade secret dispute.
- Represented a patent-holding software developer in an infringement lawsuit involving multiple patents for software development tools.
- Represented the plaintiff in a patent and trade secret case concerning business methods for insurance investment products.
- Represented a third-party provider of claims adjusting software in insurance disputes in order to preserve the software company's trade secrets.
