Paul E. Greenwalt concentrates his practice in commercial and civil litigation, with an emphasis on securities litigation and regulatory issues.

Experience

  • Successfully represented NiSource, Inc. and NESI Power Marketing, Inc. in a four month-long arbitration in 2003 stemming from the 1998 collapse of the wholesale electric power markets and the subsequent bankruptcy of The Power Company of America.

  • Successfully represented the Chicago Board Options Exchange, Incorporated in an action alleging securities fraud and antitrust violations [Cathedral Trading, LLC v. Chicago Board Options Exchange, 199 F. Supp. 2d 851 (N.D. Ill. 2002)].

  • Successfully represented Eagle Industries, Inc. in an interpleader action involving breach of warranty claims arising from a corporate transaction and a dispute over the ownership of Employee Retirement Income Security Act (ERISA) pension funds [State Street Bank and Trust Company v. Denman Tire Corp., 240 F.3d 83 (1st Cir. 2001)].

  • Represented the Cash Store Management Inc. in a federal class action alleging violations of the Truth in Lending Act [Smith v. The Cash Store Mgmt., Inc., 195 F.3d 325 (7th Cir. 1999) and Smith v. The Cash Store Mgmt., Inc., No. 00-170 (7th Cir. 2000) cert. denied sub nom Brown v. Payday Check Advance, Inc., No. 99-1951, 531 U.S. 820 (October 2, 2000)].

  • Represented Anixter Inc. in litigation involving claims for conversion, breach of fiduciary duty, and other business-related torts in connection with the termination of a joint venture [Cincinnati Bell, Inc. v. Anixter, Inc., 69 F. Supp. 2d 982 (S.D. Ohio 1999)].
