Patricia J. Fokuo divides her practice between complex civil litigation and bankruptcy issues. Her litigation practice is diverse, involving appearances before state, federal and bankruptcy courts across the country.
On the litigation side, Ms. Fokuo concentrates her practice primarily on financial fraud and securities litigation as well as intellectual property matters and contract disputes.
On the bankruptcy side, Ms. Fokuo has extensive experience representing both secured and unsecured creditors, and her practice includes the defense of preference and fraudulent transfer actions. She frequently represents utility companies, pipelines, and forward contract merchants.
Ms. Fokuo has particular experience negotiating and litigating adequate assurance issues under the Bankruptcy Code and non-bankruptcy law.
Ms. Fokuo successfully represented Consortium Service Management in BancoPanAmerica et al. v. Chastang Landfill, Inc., et al., 430 F.3d 884 (7th Cir. 2005), in which she obtained a decision disallowing the bankruptcy trustee from abandoning an executory contract.
Ms. Fokuo has experience representing clients from Central Africa seeking asylum in the United States.
