Jon C. Vigano represents and counsels Chapter 11 debtors, secured lenders, trustees, financial institutions, trade creditors, lessors, and landlords in virtually all aspects of bankruptcy law and insolvency contexts.
Recently, Mr. Vigano represented a Chapter 11 debtor in the reorganization of its business and successfully negotiated and implemented a plan of reorganization resulting in a 100% payment to the debtor's unsecured creditors. Through this engagement, he worked with the debtor's officers to restructure the company, negotiate new labor terms with the debtor's union and resolve outstanding claims against the debtor's foreign parent without additional debtor-in-possession financing.
Mr. Vigano also has significant experience defending and resolving reclamation, preference, fraudulent conveyance, and unauthorized transfer of funds claims. More particularly, he has prosecuted and defended hundreds of preference and fraudulent conveyance cases throughout the country. His experience also involves resolving bankruptcy and/or insolvency within securities, labor and employment, environmental, tax and Employee Retirement Income Security Act (ERISA) contexts. Mr. Vigano has developed significant experience in counseling officers and directors of corporations regarding their duties and obligations while in the "zone of insolvency."
In addition to his bankruptcy experience, Mr. Vigano is a seasoned transactional attorney and served as Senior Corporate Counsel for a publicly-traded corporation. Because of his blended bankruptcy and transactional experience, he is strongly qualified to assist and counsel clients in a number of contexts, including asset transactions within a bankruptcy setting.
