Gabriel M. Rodriguez has extensive experience in:
- Voluntary site remediations and brownfields redevelopment projects throughout the country
- State and federal permitting and enforcement proceedings, especially with respect to hazardous waste and water matters under Resource Conservation and Recovery Act (RCRA) and the Clean Water Act
- Defense of enforcement action taken under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA)
- Private party cost recovery litigation under CERCLA
- Defense of mass tort claims arising from environmental exposures to toxic or hazardous substances
Among his experiences:
- Acts as environmental counsel to several gas companies in the Midwest and eastern U.S. in connection with the remediation and redevelopment of former manufactured gas plants
- Represents Midwest manufacturing companies regarding the remediation, closure and disposition of former manufacturing facilities
- Litigates tort claims based on environmental exposure to hazardous substances
- Counsels electric utilities in connection with issues related to the management of coal combustion by-products
- Represents financial institutions regarding strategies for addressing environmentally-impaired real estate
- Assesses due diligence and negotiates the environmental provisions in corporate mergers and asset acquisitions and dispositions and real estate and lending transactions
Previous Experience
Prior to joining Schiff Hardin in 1988, Mr. Rodriguez was an Illinois Assistant Attorney General assigned to the Environmental Control Division, where he prosecuted environmental cases, primarily in the hazardous and solid waste and Superfund areas.
