Summary:
Schiff Hardin was hired by a major local bank to conduct an internal investigation when bank executives suspected internal fraud. Our investigation uncovered a multi-million dollar financial fraud that had potentially significant vicarious criminal liability for the bank. However, we successfully presented the case to the government in a way that avoided criminal liability of the bank.
Our attorneys also assisted the corporate client in obtaining an unqualified opinion for financial statements notwithstanding this material event. Further, we negotiated and reasoned with bank regulators with the result that no penalty was imposed.
