Summary:

Schiff Hardin represented a generator of waste drums in North Carolina. The state environmental agency commenced several Resource Conservation and Recovery Act (RCRA) and Clean Water Act (CWA) enforcement actions against the generators of waste drums improperly disposed of by a third party transporter into a navigable river without a National Pollution Discharge Elimination System (NPDES) permit.

We successfully avoided any civil penalties, facilitated the implementation of an effective response (both in terms of costs and environmental protection) and apportioned more that 75 percent of response costs to others.
