The U.S. Environmental Protection Agency (EPA) initiated an order for remedial action concerning a petroleum terminal's current and prior operators. In representing one of the prior owners and operators, Schiff Hardin successfully negotiated with the client's insurance carrier and secured an affirmative coverage determination concerning the EPA demand.

Subsequently, we persuaded the agency through jurisdictional arguments to drop its demands against our client and pursue only those who owned and operated the facility before and after our client's ownership.
