Summary:

Schiff Hardin played a major, multifaceted role in the remediation of two landfill sites originally owned and operated by the City of Toledo, Ohio.  In our position as common counsel, we:

  • Negotiated favorable terms of an Administrative Order of Consent, including exclusion of the impact on an adjacent facility
  • Negotiated construction contracts
  • Monitored construction projects
  • Managed multi-million dollar budgets
  • Worked with public funding bodies
  • Addressed unique property ownership issues
  • Managed information flow between numerous companies, individuals and community groups
  • Managed data provided to the U.S. Environmental Protection Agency (EPA) and Ohio EPA
  • Managed landfill gas migration issues

The project had a favorable impact on community economic development, helping to foster a favorable political environment for the construction of a state-of-the-art auto manufacturing plant. Most recently, the project has involved a modification in the final construction to allow for a parking lot on the completed landfill cover system, completing an institutional control study, and negotiating for the transfer of responsibility for the sites back to the City of Toledo.

This matter has involved more than 10 years of group representation, and has spanned all areas of environmental law practice, including administrative law and federal court litigation, real estate issues, scientific surveys, and risk assessment. Throughout the process, Schiff Hardin lawyers have demonstrated a deep understanding of the issues that make common counsel the right choice for a complex multi-party site.
