David A. Howard

David A. Howard has represented virtually all players in the construction process, including architects, engineers, developers, subcontractors and public utilities.

This representation spans a wide range of construction-related claims, including:

  • Design defect claims
  • Delay and impact claims
  • Breach of contract claims
  • Mechanics lien claims
  • Surety bond claims
  • Bond claims on public projects
  • Bodily injury claims

In addition, his practice involves transactional work, and includes negotiating American Institute of Architects (AIA) and manuscript construction contracts on projects ranging from single-family construction to those involving multi-million dollar construction projects.

An experienced litigator, Mr. Howard has prosecuted and defended complex construction cases. He also has substantial trial experience and has prosecuted and defended numerous dispositive motions. In addition, Mr. Howard is frequently involved in alternative dispute resolution, including arbitration, mediation and structured settlement negotiations.

Mr. Howard also is well versed in insurance law. He has prosecuted and defended declaratory judgment and other insurance related actions, including first chair arbitration and trial experience. Mr. Howard also has performed comprehensive insurance analyses with respect to wide ranging commercial, general, and environmental coverage issues.

Experience

  • Defended a nationally known architectural firm against multimillion-dollar claims of professional malpractice arising out of the design and construction of a university-owned semi-conductor cleanroom facility
  • Represented a concrete subcontractor against multimillion-dollar claims of alleged defective construction while simultaneously prosecuting the subcontractor's own multimillion-dollar claim for unpaid contract balance

Publications

Mr. Howard has published and/or contributed to the publication of several articles, including articles on international arbitration and design-build.
