David A. Fitzgerald

David A. Fitzgerald counsels electric utility, rural electric cooperative and municipal electric system clients with respect to transactional, regulatory, litigation, and legislative matters. Mr. Fitzgerald serves in a general counsel capacity advising a large coalition of power suppliers in the Southeast who purchase energy and capacity from the federal government.

He resides in Seattle, Wash.

Experience

  • Prepared report on Power Marketing Administration contracting practices for Pacific Northwest electric consumer organization
  • Negotiated power supply agreements integrating hydropower resources into organized power market
  • Represented clients in complex litigation including settlement negotiations over water use for hydroelectric generation in several U.S. District Courts and before two U.S. Courts of Appeals
  • Worked with team to negotiate several power supply agreements with an aggregate value in excess of $6 billion
  • Represented clients before the Federal Energy Regulatory Commission (FERC) in formula rate proceedings for Open Access Transmission Tariff (OATT)
  • Coordinated client's grassroots federal lobbying efforts to preserve federal funding levels for Power Marketing Administration

Previous Experience

Before joining Schiff Hardin, Mr. Fitzgerald was a partner at Sullivan & Worcester LLP. Earlier, he was an associate with Verner, Liipfert, Bernhard, McPherson and Hand.

His experience also includes six years working on Capitol Hill. During that time, he was on the staff for Senator Howard M. Metzenbaum (D-Ohio) on the Environment and Public Works Committee and the Labor and Human Resources Committee, during consideration of the Energy Policy Act of 1992.

Mr. Fitzgerald has been a contributor to the American Bar Association Annual Report of the Public Utility, Communications, and Transportation Section and Articles Editor of the Energy Law Journal.
