Brian D. Kluever's nationwide practice concentrates in real estate law, including:

  • Sales and acquisitions of office, industrial and retail properties
  • Real estate based financings
  • Leasing of office, industrial and retail space
  • Real estate development
  • Real estate taxation

In addition to focusing on the acquisition and disposition of varied and unique office, industrial, and retail property, Mr. Kluever regularly represents lenders (typically insurance companies and banks) and institutional and private investors in a wide range of real estate finance and investment transactions.

This practice is creative and comprises traditional lending transactions as well as other financing tools, such as sale and leaseback transactions, synthetic leases and joint venture interests.

The transactions have involved diverse properties, including office buildings, industrial facilities, residential facilities, mixed use facilities, recreational facilities and agricultural property.

Experience

Real estate financing and investment representations:

  • A REIT/developer in the creation of a joint venture agreement for investment in a portfolio of existing and to-be-developed commercial/industrial properties
  • A lender in a "credit tenant" based financing for a new retail outlet in Buffalo, N.Y., for Home Depot
  • A lender in a "credit tenant" based financing for a new distribution facility in Wisconsin for Federal Express
  • A lender in financing a retail/residential Chicago high-rise building
  • An insurance company as a lender in a loan to another insurance company to finance a large suburban commercial/industrial complex
  • A lender in a loan on two suburban office buildings situated on ground leases
  • A borrower in the refinancing of a downtown Chicago high-rise office building
  • A pension fund as the borrower in obtaining a loan for the construction of a new downtown Atlanta office building
  • A sale/leaseback transaction for a large warehouse/stevedoring operation with the Indiana Port Commission
