Andrew N. Sawula

Associate


Andrew N. Sawula concentrates his practice in environmental and natural resources law.

Litigation
Mr. Sawula has represented clients in federal and state courts and before administrative hearing boards in matters such as Superfund cost recovery and contribution actions, contract disputes and trade secret claims.

Enforcement
Mr. Sawula also has represented clients in enforcement actions, including notices of violation, notices of potential Superfund liability, removal actions, and a notice and invitation to participate in a Natural Resource Damage Assessment. He has negotiated settlements and Administrative Orders by Consent and has assisted clients in responding to agency requests for information.

Compliance Counseling
Mr. Sawula counsels clients on compliance issues with respect to a variety of media. He has particularly significant experience with New Source Review (NSR) compliance, such as:

  • Permitting analysis (including the application of the 2002 emissions increase test)
  • Emissions inventory reporting
  • Preparing submissions under the NSR "reasonable possibility" recordkeeping and reporting provisions for maintenance projects that do not trigger permitting requirements

Remediation and Redevelopment
Mr. Sawula counsels clients engaged in remediating and redeveloping contaminated sites, including sites with soil, groundwater and sediment contamination.

Rulemakings
Mr. Sawula represents clients' interests in administrative rulemakings and recently drafted comments on the U.S. EPA's proposed revisions to the NSR rules on behalf of a utility and an independent power producer.

Transactional Support
Mr. Sawula has represented buyers, sellers and lenders in a variety of transactional settings.
